This article provides a brief introduction to psychological emotion theories, particularly appraisal theory. According to appraisal theory emotions are combinations of a person’s appraisal of the novelty, valence, certainty, goal conduciveness, causal agency, controllability, and morality of a situation. These dimensions correspond to elements of the stories attorneys attempt to create in arguing a case. Appraisal theory puts specific content into the vague concept of reappraisal, accounting for emotional changes that go beyond the changes in valence and intensity generally studied (...) by law and emotions scholars. This paper suggests the utility of studying unconscious cognition from a selectionist perspective, specifically as outlined by theory and research in the field of behavior analysis. Currently, issues surrounding the complexity of the unconscious cognitive behaviors, the number of variables involved, and the multidirectional influences of these variables, are of utmost concern to theories of mind and behavior. Unanswered questions about these factors leave us without the ability to predict outcomes in an individual case or adequately manipulate variables in order (...) to alter outcomes. Multiple examples of current work by behavior analysts are suggested as potentially fruitful ways of addressing some of these concerns. (shrink)

BACKGROUND: Serotonin transporter promoter genotype appears to increase risk for depression in the context of stressful life events. However, the effects of this genotype on measures of stress sensitivity are poorly understood. Therefore, this study examined whether 5-HTTLPR genotype was associated with negative information processing biases in early childhood. METHOD: Thirty-nine unselected seven-year-old children completed a negative mood induction procedure and a Self-Referent Encoding Task designed to measure positive and negative schematic processing. Children were also genotyped for the 5-HTTLPR gene. (...) RESULTS: Children who were homozygous for the short allele of the 5-HTTLPR gene showed greater negative schematic processing following a negative mood prime than those with other genotypes. 5-HTTLPR genotype was not significantly associated with positive schematic processing. LIMITATIONS: The sample size for this study was small. We did not analyze more recently reported variants of the 5-HTTLPR long alleles. CONCLUSIONS: 5-HTTLPR genotype is associated with negative information processing styles following a negative mood prime in a non-clinical sample of young children. Such cognitive styles are thought to be activated in response to stressful life events, leading to depressive symptoms; thus, cognitive styles may index the "stress-sensitivity" conferred by this genotype. Editors of scientific literature rely heavily on peer reviewers to evaluate the integrity of research conduct and validity of findings in manuscript submissions. The purpose of this study was to describe the ethical concerns of reviewers of nursing journals. This descriptive cross-sectional study was an anonymous online survey. The findings reported here were part of a larger investigation of experiences of reviewers. Fifty-two editors of nursing journals (six outside the USA) agreed to invite their review panels to participate. A 69-item (...) forced-choice and open-ended survey developed by the authors based on the literature was pilot tested with 18 reviewers before being entered into SurveyMonkeyTM. A total of 1675 reviewers responded with useable surveys. Six questions elicited responses about ethical issues, such as conflict of interest, protection of human research participants, plagiarism, duplicate publication, misrepresentation of data and ‘other’. The reviewers indicated whether they had experienced such a concern and notified the editor, and how satisfied they were with the outcome. They provided specific examples. Approximately 20% of the reviewers had experienced various ethical dilemmas. Although the majority reported their concerns to the editor, not all did so, and not all were satisfied with the outcomes. The most commonly reported concern perceived was inadequate protection of human participants. The least common was plagiarism, but this was most often reported to the editor and least often led to a satisfactory outcome. Qualitative responses at the end of the survey indicate this lack of satisfaction was most commonly related to feedback provided on resolution by the editor. The findings from this study suggest several areas that editors should note, including follow up with reviewers when they identify ethical concerns about a manuscript. (shrink)

OBJECTIVES: Early-emerging, temperamental differences in fear-related traits may be a heritable vulnerability factor for anxiety disorders. Previous research indicates that the serotonin transporter promoter region polymorphism is a candidate gene for such traits. METHODS: Associations between 5-HTTLPR genotype and indices of fearful child temperament, derived from maternal report and standardized laboratory observations, were examined in a community sample of 95 preschool-aged children. RESULTS: Children with one or more long alleles of the 5-HTTLPR gene were rated as significantly more nervous during (...) standardized laboratory tasks than children who were homozygous for the short alleles. Children homozygous for the short alleles were also rated as significantly shyer, by maternal report, than those with at least one copy of the long allele of the 5-HTTLPR gene. CONCLUSIONS: This study extends the literature linking the short alleles of the serotonin transporter promoter region polymorphism to fear and anxiety-related traits in early childhood and adulthood, and is one of very few studies to examine the molecular genetics of preschoolers' temperament using multiple measures of traits in a normative sample. Animal and plant species exhibit an astonishing diversity of sexual systems, including environmental and genetic determinants of sex, with the latter including genetic material in the mitochondrial genome. In several hermaphroditic plants for example, sex is determined by an interaction between mitochondrial cytoplasmic male sterility (CMS) genes and nuclear restorer genes. Specifically, CMS involves aberrant mitochondrial genes that prevent pollen development and specific nuclear genes that restore it, leading to a mixture of female (male‐sterile) and hermaphroditic individuals in the population (...) (gynodioecy). Such a mitochondrial‐nuclear sex determination system is thought to be rare outside plants. Here, we present one possible case of CMS in animals. We hypothesize that the only exception to the strict maternal mtDNA inheritance in animals, the doubly uniparental inheritance (DUI) system in bivalves, might have originated as a mitochondrial‐nuclear sex‐determination system. We document and explore similarities that exist between DUI and CMS, and we propose various ways to test our hypothesis. (shrink)

Studies exploring how students learn and understand science processes such as diffusion and natural selection typically find that students provide misconceived explanations of how the patterns of such processes arise (such as why giraffes’ necks get longer over generations, or how ink dropped into water appears to “flow”). Instead of explaining the patterns of these processes as emerging from the collective interactions of all the agents (e.g., both the water and the ink molecules), students often explain the pattern as being (...) caused by controlling agents with intentional goals, as well as express a variety of many other misconceived notions. In this article, we provide a hypothesis for what constitutes a misconceived explanation; why misconceived explanations are so prevalent, robust, and resistant to instruction; and offer one approach of how they may be overcome. In particular, we hypothesize that students misunderstand many science processes because they rely on a generalized version of narrative schemas and scripts (referred to here as a Direct-causal Schema) to interpret them. For science processes that are sequential and stage-like, such as cycles of moon, circulation of blood, stages of mitosis, and photosynthesis, a Direct-causal Schema is adequate for correct understanding. However, for science processes that are non-sequential (or emergent), such as diffusion, natural selection, osmosis, and heat flow, using a Direct Schema to understand these processes will lead to robust misconceptions. Instead, a different type of general schema may be required to interpret non-sequential processes, which we refer to as an Emergent-causal Schema. We propose that students lack this Emergent Schema and teaching it to them may help them learn and understand emergent kinds of science processes such as diffusion. Our study found that directly teaching students this Emergent Schema led to increased learning of the process of diffusion. This article presents a fine-grained characterization of each type of Schema, our instructional intervention, the successes we have achieved, and the lessons we have learned. (shrink)

Peirce once defined pragmatism as the opinion that metaphysics is to be largely cleared up by the application of the following maxim for attaining clearness of apprehension: ‘Consider what effects that might conceivably have practical bearings we conceive the object of our conception to have. Then, our conception of these effects is the whole of our conception of the object.’ (Peirce 1982a: 48) More succinctly, Richard Rorty has described the position in this way.

A famous result of Hausdorff states that a sphere with countably many points removed can be partitioned into three pieces A, B, C such that A is congruent to B, B is congruent to C, and A is congruent to B ∪ C; this result was the precursor of the Banach–Tarski paradox. Later, R. Robinson characterized the systems of congruences like this which could be realized by partitions of the sphere with rotations witnessing the congruences. The pieces involved were nonmeasurable. (...) In the present paper, we consider the problem of which systems of congruences can be satisfied using open subsets of the sphere ; of course, these open sets cannot form a partition of the sphere, but they can be required to cover "most of" the sphere in the sense that their union is dense. Various versions of the problem arise, depending on whether one uses all isometries of the sphere or restricts oneself to a free group of rotations, or whether one omits the requirement that the open sets have dense union, and so on. While some cases of these problems are solved by simple geometrical dissections, others involve complicated iterative constructions and/or results from the theory of free groups. Hausdorff's paradoxical decomposition of a sphere with countably many points removed actually produced a partition of this set into three pieces A,B,C such that A is congruent to B, B is congruent to C, and A is congruent to B ∪ C. While refining the Banach–Tarski paradox, R. Robinson characterized the systems of congruences like this which could be realized by partitions of the sphere with rotations witnessing the congruences: the only nontrivial restriction is that the system should not require (...) any set to be congruent to its complement. Later, J. F. Adams showed that this restriction can be removed if one allows arbitrary isometries of the sphere to witness the congruences. The purpose of this paper is to characterize those systems of congruences which can be satisfied by partitions of the sphere or related spaces into sets with the property of Baire. A paper of Dougherty and Foreman gives a proof that the Banach–Tarski paradox can be achieved using such sets, and gives versions of this result using open sets and related results about partitions of spaces into congruent sets. The same method is used here; it turns out that only one additional restriction on a system of congruences is needed to make it solvable using subsets of the sphere with the property of Baire with free rotations witnessing the congruences. Actually, the result applies to any complete metric space acted on in a sufficiently free way by a free group of homeomorphisms. We also characterize the systems solvable on the sphere using sets with the property of Baire but allowing all isometries. (shrink)

The arts of rule cover the exercise of power by princes and popular sovereigns, but they range beyond the domain of government itself, extending to civil associations, political parties, and religious institutions. Making full use of political philosophy from a range of backgrounds, this festschrift for Harvey Mansfield recognizes that although the arts of rule are comprehensive, the best government is a limited one.

This paper is a review of the book: James V. Schall, The Universe We Think In (Washington, D.C.: The Catholic University of America Press, 2019). The author discusses the reasons and consequences of modern philosophy’s propensity to neglect the innate or purposeful direction of human life.

Walton takes his lead from the 1956 book by Columbia University’s C. Wright Mills, The Power Elite. The “new power elite,” Walton argues, has gravitated from business to the academy. What goes on there, he is convinced, affects every area of life, notably law, government, business, science, and, one might say, culture in general. Bewildered by the titanic changes occurring simultaneously in law, in the business world, in education, and in the family structure, Walton draws upon his considerable experience in (...) the academy to explore the ideological roots of these changes. Widely read, he is not only conversant with the major philosophical trends of the last half of the 20th century but draws upon his considerable experience in the academy as a dean of Duquesne University’s School of Business, as dean of Columbia University’s School of General Studies, and as president of The Catholic University of America. His discussion is wide ranging, but the focus is on the influence of Heidegger, Derrida, and Foucault. Philosophy, he fears, has lost its character as a science based on accurate and precise descriptions of nature and human nature, one given to making distinctions and refining definitions and finally to offering explanations. It is not and should not be, he insists, politics, propaganda, or an evangelizing instrument for cultural change. (shrink)

Previous work has reported that children creatively make syntactic errors that are ungrammatical in their target language, but are grammatical in another language. One of the most well‐known examples is medial wh‐question errors in English‐speaking children's wh‐questions (e.g., What do you think who the cat chased? from Thornton, 1990). The evidence for this non‐target‐like structure in both production and comprehension has been taken to support the existence of innate, syntactic parameters that define all possible grammatical variation, which serve as a (...) top‐down constraint guiding children's language acquisition process. The present study reports new story‐based production and comprehension experiments that challenge this interpretation. While we replicated previous observations of medial wh‐question errors in children's sentence production (Experiment 1), we saw a reduction in evidence indicating that English‐speaking children assign interpretations that conform to the medial wh‐question pattern (Experiment 2). Crucially, we found no correlation between production and comprehension errors (Experiment 3). We suggest that these errors are the result of children's immature sentence production mechanisms rather than immature grammatical knowledge. (shrink)

Earman and Ruetsche ([2005]) have cast their gaze upon existing no-go theorems for relativistic modal interpretations, and have found them inconclusive. They suggest that it would be more fruitful to investigate modal interpretations proposed for "really relativistic theories," that is, algebraic relativistic quantum field theories. They investigate the proposal of Clifton ([2000]), and extend Clifton's result that, for a host of states, his proposal yields no definite observables other than multiples of the identity. This leads Earman and Ruetsche to a (...) suspicion that troubles for modal interpretations of such relativistic theories "are due less to the Poincaré invariance of relativistic QFT vs. the Galilean invariance of ordinary nonrelativistic QM than to the infinite number of degrees of freedom of former vs. the finite number of degrees of freedom of the latter" (577-78). I am skeptical of this suggestion. Though there are troubles for modal interpretations of a relativistic quantum field theory that are due to its being a field theory—that is, due to infinitude of the degrees of freedom—they are not the only troubles faced by modal interpretations of quantum theories set in relativistic spacetime; there are also troubles traceable to relativistic causal structure. It is widely held that some kinds of deception into sex (e.g., lying about what pets one likes) do not undermine the moral force of consent while other kinds of deception do (e.g., impersonating the consenter’s partner). Tom Dougherty argues against this: whenever someone is deceived into sex by the concealment of a “deal breaker” fact, the normative situation is the same as there being no consent at all. Here it is argued that this conclusion is unwarranted. Dougherty’s (...) negative arguments against alternative theories of the deceptive undermining of consent are flawed, and his two positive arguments are unjustified. (shrink)

Varied theories and models of development have been advanced by many scholars to explain the failure of developmental theories and policies in Africa. This paper critically reviews the existing literature on the bane of development in Africa, arriving at what it considers as the most fundamental twin minions of underdevelopment in the continent. The two implicated interrelated issues are thought predicament and unwillingness to act. Whereas thought predicament affects the intellectual faculty, unwillingness to act is the defect of the volitional (...) and affective faculties. This paper strongly claims that without first rectifying these three core faculties of the African person, the continent can at best be chasing shadows. This, however, does not suggest that all other reasons for underdevelopment are insignificant or implausible. Well-planned educational system and deliberate conscientiousness towards enhancing the intellectual, volitional and affective faculties of humans are key to sustainable development of any state in Africa. This chapter opens with a discussion on Kevin Smith, Star Wars and terrorism. Terrorism means something only within a specific way of thinking about right and wrong, or, more generally, an ethical theory or framework. One very popular and powerful ethical framework is utilitarianism, which views the moral life as about producing the greatest good for the greatest number, maximizing pleasure over pain or happiness over unhappiness. The chapter describes many terrorist attacks and highlights that workers building Death Star II (...) are different from the innocents of Gaza, Hiroshima, Alderaan, and Madrid in that these workers were actively contributing to the evil intention and military goals of the enemy. The chapter further points out that the ability to challenge the dominant cultural lens through which most of us look at the world and ask critical questions of our own “side” is as rare today as it is important. With gratitude for our commentators’ thoughtful and generous engagement with Recognizing Wrongs, we offer in this reply a thumbnail summary of their comments and responses to some of their most important questions and criticisms. In the spirit of friendly amendment, Tom Dougherty and Johann Frick suggest that a more satisfactory version of our theory would cast tort actions as a means of enforcing wrongdoers’ moral duties of repair. We provide both legal and moral reasons for declining their invitation. Rebecca (...) Stone draws a particular link between civil recourse in private law theory and the right of self-defense as recognized in criminal law and moral theory. While we share Stone’s basic inclination, we argue for a different version of the link than the one that she draws. Veronica Rodriguez-Blanco provides a critique of our model of negligence law based on action theory. In response, we explain – in a way that we hope sheds light on debates over moral luck – how it is possible for the law to define negligence such that its commission depends simultaneously on the character of the defendant’s conduct and on the consequences that result from it. Though generally sympathetic to our approach, Stephen Smith faults us for failing satisfactorily to explain important remedial dimensions of tort law. Stubbornly, we insist that we can account for these, and indeed can do so on more satisfactory terms than corrective justice theorists. Finally, Erin Kelly challenges us to consider how our work might inform the analysis of two pressing issues of racial justice: overcriminalization and reparation payments. While we question whether our work to date has as much to offer on these matters as she suggests, we also maintain that the core principle of civil recourse theory – where there is a right there is a remedy – provides grounds for critiquing modern law’s failure to provide adequate accountability when police officers use excessive force against persons of color. Many of the commentaries cohere around two major points of criticism. The first is that we have omitted discussion of the mechanisms that are assumed to operate at levels 2, 3, and 4.Campbell, Cloak, Dewsbury, Eckberg, Mundinger, Pulliam, Richerson & Boyd, Slobodkin, Simon, Williams, andWahlstenall make comments that bear on this point. The second point is that we have omitted discussion of the fact that "organisms change the environment by their activities" and thereby modify the selection pressures that act on (...) them. Apart from Lewontin, this point has been raised in different forms byBarkow, Chase, Hull, Perzigian, Ruyle, and less directly bySlobodkin. Stemming from these two basic omissions there is a third general criticism. Numerous commentators have pointed out that we have failed to discuss sufficiently either the extent or nature of the constraints that may or may not be operating on supraordinate evolutionary processes as a function of their nested relationships to subordinate evolutionary processes within our scheme. We start by acknowledging these three basic omissions. We agree that they exist and that they are serious. (shrink)
